PALM BEACH, FL – Florida\u2019s new license plate law was intended to solve a real problem. Lawmakers aimed to curb toll evasion, traffic camera avoidance, and the growing use of altered or obscured license plates that make vehicles harder to identify. Few would dispute the legitimacy of that goal.<\/p>\n\n\n\n

What has followed, however, is a textbook example of how overbroad legislation can force executive agencies into an uncomfortable and arguably improper role \u2014 effectively rewriting the law through enforcement guidance rather than through the legislative process.<\/p>\n\n\n\n

At the center of the controversy is the statute\u2019s sweeping language, which appears to criminalize any obstruction of any<\/em> part of a license plate, including design elements, county identifiers, and even non-essential graphics. Under a strict reading, many commonplace license plate frames – including dealer-branded frames long used across Florida – could fall within the law\u2019s reach.<\/p>\n\n\n\n

Faced with public confusion and industry backlash, the Florida Department of Highway Safety and Motor Vehicles (FLHSMV) issued a memo clarifying that license plate frames are not outright prohibited, so long as the alphanumeric characters and registration decal remain visible. While this clarification eased immediate concerns, it also exposed a deeper governance issue: when agencies step in to narrow laws that lawmakers wrote too broadly, who is really making the law?<\/p>\n\n\n\n

The Statute vs. the Memo<\/h4>\n\n\n\n

The statute itself is blunt. It prohibits any device that obscures, alters, or interferes with the visibility of the plate, including its design features and identifying information. There are no express carve-outs for dealer frames, decorative borders, or long-standing industry practices.<\/p>\n\n\n\n

The FLHSMV memo, by contrast, introduces a hierarchy of importance. According to the agency, only two elements are \u201cprimary\u201d for enforcement purposes – the alphanumeric plate number and the registration decal. Other features, such as bottom slogans or decorative graphics, are treated as secondary and not enforcement priorities so long as the issuing state remains identifiable.<\/p>\n\n\n\n

This is not an amendment to the law. It is an enforcement policy choice.<\/p>\n\n\n\n

That distinction matters.<\/p>\n\n\n\n

Why This Creates Legal Uncertainty<\/h4>\n\n\n\n

From a rule-of-law standpoint, citizens and businesses are expected to rely on statutes enacted by elected representatives, not informal guidance issued after the fact. When a statute says one thing and an agency memo says another, compliance becomes less about what the law is<\/em> and more about how it is currently being enforced<\/em>.<\/p>\n\n\n\n

That creates three practical problems.<\/p>\n\n\n\n

First, enforcement discretion becomes uneven. One officer may follow the memo faithfully. Another may enforce the statute as written. Both can plausibly claim to be acting within their authority.<\/p>\n\n\n\n

Second, businesses – particularly car dealers – are placed in a position of reliance on policy rather than law. Dealer-branded plate frames may be tolerated today, only to become the subject of citations tomorrow if enforcement priorities change or guidance is withdrawn.<\/p>\n\n\n\n

Third, courts are not bound by agency memos. If a citation is challenged, a judge will look first to the statutory text. The memo may inform context, but it does not override the law passed by the Legislature.<\/p>\n\n\n\n

The Role of the Legislature<\/h4>\n\n\n\n

This is where legislative responsibility becomes unavoidable.<\/p>\n\n\n\n

When lawmakers draft statutes with language so broad that agencies must narrow them to avoid absurd or disruptive outcomes, the proper remedy is not permanent agency clarification. It is statutory amendment.<\/p>\n\n\n\n

Legislatures exist to balance competing interests – public safety, commerce, enforceability, and fairness. Agencies exist to carry out those decisions, not to quietly revise them.<\/p>\n\n\n\n

A narrowly tailored amendment – explicitly permitting license plate frames that do not obstruct the plate number or registration decal – would immediately resolve the ambiguity. It would align the law with the state\u2019s stated intent while providing certainty to motorists, dealers, and law enforcement alike.<\/p>\n\n\n\n

Without such an amendment, Florida remains in a gray area where legality depends less on what the law says and more on how it is currently interpreted.<\/p>\n\n\n\n

Why This Matters to the Auto Industry<\/h4>\n\n\n\n

For car dealers, this issue is not academic. Dealer plate frames are a long-standing, low-cost branding tool that places a business name in daily view on thousands of vehicles. Sudden criminalization – even temporarily – has real operational and reputational consequences.<\/p>\n\n\n\n

More broadly, the situation highlights a recurring problem in regulatory governance: industries are often forced to operate in policy limbo while agencies attempt to soften the edges of hastily written laws.<\/p>\n\n\n\n

That is not a sustainable model for compliance or confidence.<\/p>\n\n\n\n

A Preventable Problem<\/h4>\n\n\n\n

Florida\u2019s license plate law was well-intentioned. The confusion surrounding it was not inevitable. Clear drafting could have prevented the need for agency intervention altogether.<\/p>\n\n\n\n

When agencies are compelled to act as legislative editors, it is usually a sign that the statute itself needs attention. Until lawmakers step in, Florida\u2019s drivers and auto dealers are left navigating a legal landscape shaped as much by memos as by law.<\/p>\n\n\n\n

That may solve a short-term problem, but it raises a longer-term question: who should really be responsible for fixing bad laws?<\/p>\n\n\n\n
