File photo: Gunter Nezhoda, licensed.

WASHINGTON, D.C. – The Federal Trade Commission (FTC) is reinforcing its expectations for transparent automobile pricing, warning dealerships that advertised vehicle prices must accurately reflect what consumers can actually pay. The agency’s September 2026 guidance, followed by additional remarks from consumer protection officials, places renewed attention on hidden fees, conditional discounts, financing offers, and misleading online vehicle advertisements.

Advertised Vehicle Prices Must Reflect Actual Costs

According to the FTC’s automobile pricing transparency guidance, an advertised vehicle price must represent an amount any consumer can actually pay to purchase the vehicle, excluding only government-required charges that consumers are legally obligated to pay.

Mandatory dealer documentation fees, processing charges, preparation fees, and other required expenses generally must be incorporated into the advertised price. Simply describing a charge as a government-authorized fee does not automatically qualify it for exclusion.

Discounts, Rebates, and Optional Add-Ons

Dealers may advertise special discounts for military personnel, first responders, or customers using particular financing arrangements. However, the price available to all consumers must remain the most prominent advertised amount. Conditional discounts cannot be used to create the misleading impression that every buyer qualifies for a lower price.

Optional products, including extended warranties, protection packages, and accessories, must genuinely be optional. If a dealership requires customers to purchase an add-on, its cost must be included in the advertised vehicle price.

What About Buy Here, Pay Here Financing?

Dealerships offering in-house financing must also ensure that their advertisements accurately describe financing arrangements. Advertising a down payment or weekly installment without the appropriate disclosures can create compliance concerns under the Truth in Lending Act and Regulation Z.

For example, advertising “$3,000 down and $100 per week” can trigger additional disclosure requirements, including the annual percentage rate (APR), repayment terms, and other financing information. Dealers should review these advertisements carefully rather than assuming that displaying a payment amount alone is sufficient.

Online Vehicle Listings Are Not Exempt

The FTC’s expectations extend beyond dealership showrooms to vehicle inventory websites, online marketplaces, social media advertisements, classified listings, and other advertising channels. When a webpage displays an amount a consumer may pay, the actual purchase price must be presented as the most prominent amount.

Third-party advertising providers should also pay attention to the accuracy of the information they publish, particularly when they exercise control over vehicle pricing representations. Listings that omit prices entirely raise different questions, but displaying “Call for Price” does not automatically resolve every applicable advertising or disclosure obligation.

FTC Enforcement Is More Than a Warning

On October 8, 2026, the FTC announced a proposed settlement involving Greenway Auto Group over allegations that dealerships advertised vehicles at prices substantially below what consumers ultimately paid. The agreement would require more transparent advertised pricing, illustrating the potential consequences of deceptive pricing practices.

What Used Car Buyers Should Do

Consumers shopping for used vehicles should request a written, itemized out-the-door price before visiting a dealership. Buyers should also verify whether advertised discounts require special qualifications, whether additional products are mandatory, and how financing terms affect the total purchase cost. Suspected deceptive advertising practices can be reported directly to the FTC at ReportFraud.ftc.gov.

Sources: Federal Trade Commission Pricing Transparency FAQs; ComplyAuto, October 5, 2026.
