File photo: Gunter Nezhoda, ShutterStock.com, licensed.<\/figcaption><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\">WASHINGTON, D.C. &#8211; The official launch of the Federal Trade Commission\u2019s (FTC) Combating Auto Retail Scams (CARS) Rule \u2013 which would make it illegal for a dealer to make misrepresentations about certain topics that would affect a consumer\u2019s buying or leasing choices \u2013 has&nbsp;<a href=\"https:\/\/www.ftc.gov\/news-events\/news\/press-releases\/2024\/01\/ftc-pauses-cars-rule-effective-date\" target=\"_blank\" rel=\"noreferrer noopener\">been paused by the agency<\/a>&nbsp;amid a&nbsp;<a href=\"https:\/\/www.consumerfinancemonitor.com\/2024\/05\/21\/ftc-files-opposition-to-petition-challenging-cars-rule-in-the-5th-circuit\/\" target=\"_blank\" rel=\"noreferrer noopener\">legal challenge brought by two industry groups<\/a>&nbsp;representing auto sellers. Originally, the rule was slated to go in to effect on June 30, 2024.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CARS Rule addresses several issues that consumers have complained about in recent years, including fraudulent behavior on the part of unscrupulous sellers such as bait-and-switch tactics, so-called <em>\u201cjunk fees\u201d<\/em> added to the purchase prices of the vehicles for \u201c<em>unnecessary<\/em>\u201d services such as certification, reconditioning, or inspections, and deceptive claims about price, financing, or add-ons.<\/p>\n\n\n\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\"><div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">New CARS Rule will protect car buyers: Lower monthly payment? S. Court of Appeals for the Fifth Circuit. The petition filed by NADA claims that the FTC committed the following acts:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Unlawfully issued the CARS Rule without the required advance notice of proposed rulemaking (\u201cANPR\u201d)<\/li>\n\n\n\n<li>&nbsp;Failed to articulate a rational connection between its factual findings and its decision to impose a far-reaching, industry-wide rule<\/li>\n\n\n\n<li>&nbsp;Unreasonably and arbitrarily evaluated the benefits and costs of the CARS Rule<\/li>\n<\/ol>\n\n\n\n<p class=\"wp-block-paragraph\">The FTC has responded to the petition, saying that \u2013 due to the&nbsp;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Dodd%E2%80%93Frank_Wall_Street_Reform_and_Consumer_Protection_Act\" rel=\"noreferrer noopener\" target=\"_blank\">Dodd-Frank Act<\/a>&nbsp;\u2013 the agency was not required to provide an ANPR prior to proposing the rule, did not need to demonstrate industry misconduct or a regulatory gap to justify it, and that the justification of the rule\u2019s cost-benefit analysis is not subject to judicial review.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The CARS Rule, as claimed by the FTC when it first announced it&nbsp;<a href=\"https:\/\/www.caranddriver.com\/news\/a46155818\/ftc-new-car-pricing-rule-explained\/\" target=\"_blank\" rel=\"noreferrer noopener\">in December 2023<\/a>, would<em> \u201csave consumers more than $3.4 billion and an estimated 72 million hours each year shopping for vehicles by targeting persistent and illegal bait-and-switch scams and junk fees in the car buying process.\u201d<\/em><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The rollout of the CARS Rule will remain stayed pending a ruling by the Fifth Circuit.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>WASHINGTON, D.C. &#8211; The official launch of the Federal Trade Commission\u2019s (FTC) Combating Auto Retail Scams (CARS) Rule \u2013 which would make it illegal for a dealer to make misrepresentations about certain topics that would affect a consumer\u2019s buying or leasing choices \u2013 has&nbsp;been paused by the agency&nbsp;amid a&nbsp;legal challenge brought by two industry groups&nbsp;representing [&hellip;]<\/p>\n","protected":false},"author":4,"featured_media":974,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_genesis_hide_title":false,"_genesis_hide_breadcrumbs":false,"_genesis_hide_singular_image":false,"_genesis_hide_footer_widgets":false,"_genesis_custom_body_class":"","_genesis_custom_post_class":"","_genesis_layout":"","footnotes":""},"categories":[3],"tags":[],"class_list":["post-973","post","type-post","status-publish","format-standard","has-post-thumbnail","category-market-updates","entry"],"aioseo_notices":[],"aioseo_head":"\n\t\t<!-- All in One SEO 4.9.10 -
